These Terms of Service ("Terms") govern your access to and use of the website, software applications, compliance tools, and services provided by Hosteva ("Hosteva," "we," "our," or "us"). By creating an account, searching an address, or subscribing to our services, you agree to be bound by these Terms.

1. Description of Services

Hosteva provides an automated short-term rental (STR) compliance research platform, including address geocoding, municipal zoning status checks, jurisdictional authority mapping, step-by-step regulatory checklists, and municipal fee schedules when available (the "Services"). Phase I Compliance Essentials does not include AI chat or real-time ordinance alerts.

2. NOT LEGAL, TAX, OR PROFESSIONAL ADVICE (CRITICAL DISCLAIMER)

HOSTEVA IS AN AUTOMATED COMPLIANCE RESEARCH AND DATA AGGREGATION TOOL. HOSTEVA IS NOT A LAW FIRM, CERTIFIED PUBLIC ACCOUNTANT (CPA) FIRM, OR GOVERNMENT AGENCY, AND DOES NOT PROVIDE LEGAL, TAX, OR LICENSING ADVICE.

All regulatory summaries, zoning determinations, fee schedules, and checklists provided through Hosteva are for informational purposes only. Local municipal codes, county ordinances, and state regulations change frequently and may be subject to subjective administrative interpretations. You, as the property owner or manager, are solely and exclusively responsible for verifying all local requirements, submitting official applications, paying applicable fees, and ensuring your property operates in full compliance with all governing laws.

3. User Accounts and Responsibilities

  • Account Security: You must provide accurate, current, and complete information during registration. You are responsible for safeguarding your login credentials.
  • Accurate Property Information: You agree to provide accurate physical addresses, property types, and ownership details. Hosteva is not responsible for inaccurate checklist output resulting from erroneous user input.
  • Lawful Use: You agree not to use the Services for any unlawful purpose, including attempting to circumvent municipal bans, misrepresenting licensing status, or scraping Hosteva's proprietary database.

4. Subscription, Billing, and Cancellations

  • Subscription Tiers: Paid access to "Compliance Essentials" is billed on a recurring monthly ($9.99/month per property) or annual ($99/year per property) basis.
  • Payment Processing: Payments are processed securely through Stripe. By subscribing, you authorize Hosteva to charge your chosen payment method at the beginning of each billing cycle.
  • Cancellation: You may cancel your subscription at any time through your Account Settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current paid billing period.
  • Refund Policy: All subscription fees are non-refundable for partial billing periods.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOSTEVA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Municipal fines, civil citations, tax penalties, or stop-work orders levied against you or your property;
  • Deactivation, suspension, or penalties imposed by third-party platforms (including Airbnb, Vrbo, or Booking.com);
  • Loss of rental revenue, profits, or business reputation arising from your use of or inability to use the Services.

HOSTEVA’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO HOSTEVA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. Indemnification

You agree to defend, indemnify, and hold harmless Hosteva and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your violation of these Terms, your operation of a short-term rental, or your failure to obtain required government permits.

7. Intellectual Property

All content, software, databases, branding, and algorithms on Hosteva are the exclusive property of Hosteva and are protected by United States and international copyright, trademark, and intellectual property laws.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida.
